The American Medical Association reports that 81% of physicians already use some healthcare AI tool and 76% acknowledge a clinical benefit, but the same survey shows patient data privacy (86%) and safety validation (88%) remain the leading barriers to adoption. In radiology, where agentic AI is already woven into triage, prioritization and report generation, that contrast — widespread use alongside well-founded skepticism — is exactly what clinical leaders need to address before signing a contract. The five questions below, synthesized from a recent piece by CIVIE CEO Dhruv Chopra, are the minimum filter that separates serious vendors from trade-show hype.

1. How does the vendor handle patient data?

Before debating algorithm performance, ask where the data lives. Healthcare is the industry with the highest average breach cost — $10 million per incident, according to the IBM Cost of a Data Breach Report. HIPAA in the United States, GDPR in Europe and emerging frameworks in Latin America classify health data as sensitive, with active enforcement and material fines. Workflows that involve continuous model retraining must spell out whether anonymization is effective, whether encryption keys are customer-exclusive and what the civil liability looks like if an incident occurs.

2. Is there independent certification?

Third-party validation separates software from medical-grade software. The badges to look for are HITRUST CSF, SOC 2 Type II and ISO 27001. Specifically in healthcare, HITRUST consolidates HIPAA, NIST and ISO controls into a single auditable framework, and is today the de facto standard in the U.S. market. Vendors that already serve hospitals certified by Joint Commission International or comparable bodies usually have similar processes, but ask for the full audit report — not just the logo on the website.

3. Was the model clinically validated — and in whom?

Validating accuracy on internal datasets isn’t enough. Directors should request peer-reviewed publications with external cohorts, metrics including sensitivity, specificity, AUC and PR curve, and stratification by demographic subgroup. Models trained on predominantly white populations frequently fail in Black and Asian patients — documented in studies on melanoma detection, chest x-rays and ECG. Algorithmic bias is a liability issue, not merely an ethical one. Hospitals where AI now beats radiologists on early pancreatic cancer published the raw figures before commercialization.

4. Who is responsible when the algorithm errs?

Contracts must define a clear chain of responsibility. Does the vendor cover indemnities up to what limit? What are the notification costs to patients in the event of an incident? And in clinical decisions that hinged on model output, who answers — the validating radiologist, the purchasing hospital or the developer? This is especially thorny in autonomous or agentic systems that act without immediate human review. The American College of Radiology recommends final interpretation stays with the radiologist to avoid gray zones, but that is not what every SaaS contract says in practice. 5. What is the maintenance and drift plan?

AI is not software delivered “once.” Models drift as patient distribution shifts, new acquisition protocols enter the floor and scanner versions are updated. Ask the vendor: how often is the model retrained? Who monitors production performance? Is there a metrics dashboard the customer can access? What is the communication plan when a version is deprecated? Mature vendors ship public model cards, version logs and clear transition windows.

The regulatory landscape

In 2024-2025 the FDA published an updated framework for AI/ML-based software as a medical device (SaMD) with predetermined change control plans, allowing vendors to update models without each tweak triggering a full review — but requiring post-market surveillance. Europe’s AI Act adds requirements specific to high-risk medical AI, and emerging markets are racing to align. There is also ongoing debate at professional societies about machine-generated reports and the limits of automated reading. Academic medical centers are demanding tougher contractual clauses, and that rigor is spreading to private hospitals and outpatient imaging chains.

The key takeaway: the people leading this evaluation should not be only the chief radiologist. IT, information security, legal and compliance need to share a single committee. Treating AI procurement as a purely clinical purchase is the fastest way to regulatory and contractual trouble down the line.

Beyond the five questions

The CIVIE article, alongside the AMA survey, shows the conversation has shifted from “if” to “how.” Avoiding AI in radiology today is practically impossible: triage tools, voice-to-report language models and worklist prioritization are embedded in systems many clinics already operate without realizing it. The administrator’s job is to demand, at the next contract renewal, verifiable evidence on each of those five fronts. Recent investments — like the $150M raise by Aidoc — show the market remains well-capitalized, which means the buyer’s leverage is higher than many directors assume.
